Proposed ban on the use of certain types of aluminium composite panels

The NSW Commissioner for Fair Trading, Rose Webb, called for public submissions on whether a building product use ban was warranted for certain types of external cladding on buildings and if so, what the terms of a ban might be.

A building product ban can be made if the use of a building product poses a safety risk. This ban is intended to come into force on Wednesday 15 August 2018 and will remain in force until it is revoked.

At least 48 hours are provided as a notice to manufacturers of intention to impose the ban in accordance with the Building Products (Safety) Act 2017. Failure to comply with requirements of the ban can be subjected to fines up to $1.1 million for corporations and $220,000 for individuals.
